1. Acceptance of Terms

By accessing and using the website of Built Different Coaching (“we,” “us,” or “our”) (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of the terms, you must not use the Service.

2. Disclaimer of Professional Advice

You acknowledge and agree that:

  • Coaching is not a substitute for professional advice. The coaching services, content, and information provided (including through the AI chat) are for informational, motivational, and educational purposes only. They are not intended as, and do not constitute, medical, psychological, legal, financial, or any other professional advice.
  • You are solely responsible for your decisions, actions, and results in life and business.
  • The use of the Service, including the AI chat, does not create any professional relationship between you and Built Different Coaching other than a commercial relationship governed by these Terms.

3. Australian Consumer Law (ACL) and Guarantees

  • Consumer Guarantees: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. If a failure does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time.
  • Exclusions: To the fullest extent permitted by law, we exclude all other guarantees, conditions, warranties, or terms that would otherwise be implied by statute, general law, or custom, except where prohibited by the ACL.

4. Use of the Site and Intellectual Property

  • IP Ownership: All content, materials, and digital products provided as part of the Service (including coaching documents and graphics) are the intellectual property of Built Different Coaching.
  • Licence: You are granted a non-exclusive, non-transferable licence to use the materials only for your personal, non-commercial use. You must not copy, reproduce, distribute, or create derivative works from the materials without our express written permission.

5. AI Chat Service (Tawk.to)

The AI chat is provided as a convenience feature. By using it, you agree:

  • Data Collection: Your chat interactions are collected and stored by our third-party provider, Tawk.to, as detailed in our separate Privacy Policy.
  • Reliability: We do not warrant the accuracy or completeness of any information provided by the AI.

6. Limitation of Liability

To the fullest extent permitted by law (including the ACL), Built Different Coaching excludes all liability for any loss, damage, expense, or injury (including indirect, incidental, special, consequential, or punitive damages) that you may suffer or incur as a result of using the Service or relying on any information provided by the Site or coaching materials.

7. Refunds and Cancellations

  • Specific Service Terms: Refund and cancellation policies for specific coaching programs will be detailed in the separate Coaching Service Agreement provided to you upon enrolment, which must comply with the ACL.
  • Statutory Rights: This clause does not limit any rights or remedies available to you under the Australian Consumer Law.

8. Governing Law

These Terms are governed by the laws of New South Wales (NSW) and the Commonwealth of Australia. You agree to submit to the exclusive jurisdiction of the courts of NSW.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of changes by posting the new Terms on the Site. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms of Service.
